Saville is still alive but I don't believe he has the rights to that particular image. I could be wrong but I think he himself took it from an astronomy book. He definitely should get credit for it but you know how that goes.
I was thinking more of Ian doing the spinning.
It's one thing for Supreme to actually work with Saville to do something limited and it's another for Raf to use it back when he did. And didn't Attachment do a knit sweater of this? here's a story about the copyright for that computer generated illustration.
tl;dr
The image was first published in the US without a copyright (as far as I can tell) in the year 1971, so therefore it is in the public domain for failure to comply with copyright formalities of the time.
is that's correct, did joy division/peter saville obtain permission to use this graph from the scientific publisher? unknown pleasures was released in 1979 and there should have been copyright on that image..

Ha, I wasn't aware that Saville was still breathing, also his production has been second to none for a fair amount of years now. Still, that guy should be set on fire (Wright, not Saville).
As for that new image, it's a distorsion of the original graph hence an artist's creation, to what degree it's to be related to the original (therefore be classed as a copy and pay fees) is a matter of justice or shared approbation if I'm not wrong... Reminds me that I should go back and study about this again.

Saville is definitely still around. Just a few years ago (or was it 5?) he did a collaboration with Slater Bradley for a very limited series of shirts (42) sold at Atelier:
